LIMITATION OF LIABILITY:
TO THE FULL EXTENT PERMISSIBLE UNDER THE APPLICABLE LAW, STAR GAMING NETWORK SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR INABILITY TO USE STAR GAMING NETWORK WEB SITES OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH STAR GAMING NETWORK OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF PROFITS, USE, DATA, OR OTHER INTANGIBLE PROPERTIES, EVEN IF STAR GAMING NETWORK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
INDEMNIFICATION:
You agree to defend, indemnify and hold harmless the Star Gaming Network, its affiliated companies, its employees, contractors, officers and directors, from all liabilities, claims and expenses, including attorney's fees, that arise from breach of the terms of this Agreement, or in connection with, the transmission of any Information on the the Star Gaming Network Web Sites or the Internet by or through the Star Gaming Network accounts.
TERMINATION:
You or the Star Gaming Network may terminate your Account at any time for any reason. Once your Account is terminated, you cannot access the the Star Gaming Network Web Site in any manner or for any reason without the express written consent of the Star Gaming Network, and you cannot assist in enabling a terminated participant to access the the Star Gaming Network Web Site using or via your Account.
MISCELLANEOUS:
This Agreement shall be governed by and construed in accordance with the laws of the state of California, and you agree to submit to the personal jurisdiction of the courts of the state of California for any cause or action arising out of this Agreement. In the event that any portion of this Agreement is deemed by a court to be invalid, the remaining provisions shall remain in full force and effect. |
